In 2024 we launched our Physics World Live series of panel discussions. In September, we explored the future of particle physics with Tara Shears of the UK’s University of Liverpool, Phil Burrows at the University of Oxford in the UK and Tulika Bose at the University of Wisconsin–Madison in the US. Moderated by Physics World’s Michael Banks, the discussion focussed on next-generation particle colliders and how they could unravel the mysteries of the Higgs boson and probe beyond the Standard Model of particle physics. Neutrinos do not fit in nicely with the Standard Model of particle physics because of their non-zero masses. As a result some physicists believe that they offer a unique opportunity to do experiments that could reveal new physics. In a wide-ranging interview, the particle physicist Juan Pedro Ochoa-Ricoux explains why he has devoted much of his career to the study of these elusive subatomic particles. He also looks forward to two big future experiments – JUNO and DUNE – which could change our understanding of the universe.
This year marked the 70th anniversary of the world’s most famous physics laboratory, so the last two items in my list celebrate that iconic facility nestled between the Alps and the Jura mountains. Formed in the aftermath of the Second World War, which devastated much of Europe, CERN came into being on 29 September 1954. That year also saw the start of construction of the Geneva-based lab’s proton synchrotron, which fired-up in 1959 with an energy of 24 GeV, becoming the world’s highest-energy particle accelerator. The original CERN had 12 member states and that has since doubled to 24, with an additional 10 associate members. I am inclined to agree with STUDENT'S NAME on the matter of STUDENT'S OPINION, as her assertion is backed by a compelling reason that STUDENT'S MAIN IDEA. This appeal was made at the instance of the contesting Respondent in both the Civil Appeals who was really aggrieved of a clause in the prospectus issued by the Appellants, which according to her was not valid. According to the contesting Respondent, she being a Canadian Citizen is an N.R.I., that, therefore, she was entitled to seek admission to the M.B.B.S. course in the NRI category quota but yet the definition of N.R.I. as specified in the prospectus issued by the Chandigarh Administration and the Government Medical College, Chandigarh for the academic year 2012-13 would denude her of such status and, therefore, it was liable to be struck down.
The contesting Respondent claimed that her grand-father retired as an Under Secretary in the year 1994, that when was in house from 1964 to 1983 and shifted to another Government accommodation provided by the Chandigarh Administration form 1983 to 1993, that third set of Government accommodation was provided by the Government to the father of the contesting Respondent which was occupied till December 2003 and that thereafter, her father started living in the house of her grandfather in Mohali. The contesting Respondent claimed that she passed as a regular student from Mohali, that the prescription contained in paragraph 2 of the prospectus providing for eligibility and merit for N.R.I. seats for M.B.B.S. course stipulating that the grandparents or parents of the candidates should be resident of Chandigarh for a minimum period of 5 years at any time since the origin of Chandigarh for the last at least 5 years and a certificate to that effect issued by D.C. cum-Estate Officer or Municipal Corporation of Chandigarh. It was on that footing that a challenge came to be made by the contesting Respondent in the High Court in C.W. P. No. 1423 of 2011.
The learned Single judge by order held that impugned clause was totally impracticable, illegal, illogical and declared as such. However, the learned Single Judge went further into the question as to whether the contesting Respondent can be granted admission.
This special leave petition has been filed against the judgment and order dated 24th April, 2008 passed in Writ Petition No. 28 of 2006 by the High Court of Andhra Pradesh by which the writ petition against the order of dismissal of the petitioner’s application and successive appeals under the Right to Information Act, 2005 has been dismissed. In the said petition, the direction was sought by the Petitioner to the Respondent No. 1 to provide information as asked by him vide his application dated 15th November, 2004 from the Respondent No. 4 a Judicial Officer as for what reasons, the Respondent No. 4 had decided his Miscellaneous Appeal dishonestly.
The facts and circumstances giving rise to this case are, that the petitioner claimed to be in exclusive possession of the land in respect of which civil suit No. 810 of 2000 was filed before Additional Civil Judge, Ranga District praying for perpetual injunction by Dr. Rao against the petitioner and another from entering into the suit land. Application filed for interim relief n the said suit stood dismissed. Being aggrieved the plaintiff therein preferred C.M.A. No. 180 of 2000 and the same was also dismissed. Two other suits were filed in respect of the same property impleading the Petitioner also as the defendant. In one of the suits i.e. O.S. No. 875 of 2003, the trial court granted temporary injunction against the petitioner being aggrieved, petitioner preferred the C.M.A. no. 64 of 2003, which was dismissed by the appellate court respondent No. 4 vide order dated 10th August, 2004.
Petitioner filed an application dated 15th November, 2004 under Section 6 of the R.T. I. Act before the Administrative Officer cum assistant state Public Information Officer (respondent No. 1) seeking information to the queries mentioned therein. The said application was rejected vide order dated 23rd November, 2004 and an appeal against the said order was also dismissed vide order dated 20th January, 2005. Second appeal against the said order was also dismissed by the Andhra Pradesh Information Commission vide order. The petitioner challenged the said order before the High Court seeking a direction to the Respondent No. 1 to furnish the required information immediately.
The appellant was convicted by the trial court under Sectio 306 I.P.C. on the allegation that his farm labour (deceased) committed suicide because of the harassment meted out to him by appellant. The prosecution case was that the appellant, two days prior to the incident, levelled an allegation of theft of ornaments against the deceased; that the appellant had also demanded from the deceased Rs. 7000/- which was given to him as advance at the time when he was kept in employment. The conviction was affirmed by the High Court. In the instant appeal filed by the accused, it was contended for the appellant that the conviction of the appellant was unsustainable as no ingredients of offence punishable u/s 306 I.P.C. were made out. Abetment involved a mental process of instigating a person or intentionally aiding a person in doing of a thing. Without a positive act on the part of the accused to instigate or aid in committing suicide, conviction cannot be sustained.
The intention of the Legislature and the ratio of the cases decided by this court is clear that in order to convict a person u/s 306 I.P.C. there has to be a clear mens rea to commit the office. It also requires an active act or direct act must have been intended to push the deceased into such a position that he committed suicide. In the instant case, the deceased was undoubtedly hyper sensitive to ordinary petulance, discord and differences which happen in day to day life. Human sensitivity of each individual differs from the other. Different people behave differently in the same situation. In the light of the provisions of law and the settled legal positions crystallized by a series of judgments of this court, the conviction of the appellant cannot be sustained. The word suicide in itself is nowhere defined in the Indian Penal Code, however its meaning and import is ell known and requires no explanation. ‘Sui’ means ‘self’ and ‘cide’ means ‘killing’, thus implying an act of self-killing. In short a person committing suicide must commit it by himself, irrespective of the means employed by him in achieving his object of killing himself.
Suicide by itself is not an offence under either English Law or Indian Criminal Law.
