1. Did Paul validly serve?
Proper Summons/Service of Process

California, there would be no purposeful availment on the part of Meyer
Corp.
Specific Jurisdiction
If the plaintiff’s claim is directly related to the defendant’s contacts with the
forum state, then there will be specific personal jurisdiction for that claim
only.
The facts do not indicate that Meyer Corp. took any actions targeting
California. If the action here arose out of Meyer’s contacts with the forum,
such as targeting business there, there would be specific jurisdiction since the injury was caused by the tainted snacks eaten by Paul in California.
Essentially at Home–General Jurisdiction
The modern rule for general jurisdiction requires the defendant to have
systematic and continuous contacts with the forum state such that the
defendant is “essentially at home” in the forum state.
As a German company with its sole place of business in Germany, Meyer
Corp. is not essentially at home in California, so there would be no basis
for general jurisdiction.
Fairness Factors
The exercise of jurisdiction must be fair and reasonable, so the court will
assess a number of factors, including: the plaintiff’s interest in convenient
relief, the location of witnesses and evidence, the forum state’s interest in
regulating activities and protecting its citizens, the burden on the defendant
to travel to the forum state, and interstate efficiency interests.
Paul is presently in California and has a strong interest in obtaining
redress for his injuries from the tainted snacks. California as a forum may
be unfair because all witnesses regarding the manufacture of the snacks are
in Germany, so even though they are a corporation, it would be very
financially burdensome to defend a suit in California since Meyer has no
contacts in California. However, all witnesses about the snack purchase and
the injury resulting from the snacks are in California, as is the co-defendant
Valerie. Further, California has a strong interest in redressing injuries
occurring from contaminated snacks consumed in its jurisdiction, but since
Paul is a Mexican citizen on a student visa, the state’s interest is slightly
less. Overall, it would not be unfair or unreasonable, assuming Meyer Corp.
had directed some activities towards the California market.
Personal jurisdiction is likely proper if Meyer Corp. had directed snackmarketing activities towards the California market.
3. Does venue properly lie in California Superior Court in San Diego?
Venue
Venue is proper in any county where the claim arose (injury occurred) or the
defendant resides.
The cause of action arose in San Francisco since Paul was attending a
musical festival there when he was injured after he consumed the
contaminated snacks he had purchased from Valerie. Valerie is a resident of
San Francisco County and Meyer Corp. is a resident of Germany. Thus,
there is no basis for Venue in San Diego, but venue is proper in San Francisco County.
4. Is Paul’s action removable?
Removal
A defendant may remove to federal court if a case is brought in state court,
but could have properly been brought in federal court. However, when the
basis for subject matter jurisdiction is diversity and one of the defendants is
a citizen of the forum state, the action is not removable. All defendants must
agree to the removal and must remove no later than 30 days after service of
the first removable document, but never later than one year after the initial
filing.
To have been brought in federal court in the first place, the first inquiry is
if the federal court has proper subject matter jurisdiction.
Subject Matter Jurisdiction
Federal subject matter jurisdiction means the court has proper jurisdiction
over the subject matter of an action. Federal courts have limited subject
matter jurisdiction and may only hear cases involving federal questions or
diversity of citizenship (or alienage jurisdiction), which requires complete
diversity and where the claim exceeds $75,000. Domicile determines a
person’s citizenship.
There is no federal question to Paul’s claim so that will not provide a
basis for subject matter jurisdiction. For diversity purposes, Valerie is
domiciled in San Francisco, and Meyer Corp. is an alien since it is
domiciled in Germany and solely conducts business in Germany. Since Paul
is in California on a student visa and is a Mexican citizen, he only
temporarily has a California domicile because while he is physically
present, he does not have a subjective intent to remain, making him an alien
for diversity purposes. While the parties are fully diverse from one another,
this will not satisfy the diversity requirement because there are aliens on
both sides of the action, but there also must be diverse citizens of the U.S.
on each side of the controversy. Further, in diversity cases the defendant
may not remove to federal court if she is a citizen of the forum state and
Valerie is a citizen of California.
Lastly, Paul is alleging $50,000 in damages, which is insufficient for
diversity jurisdiction.
Paul’s action is not removable for lack of subject matter jurisdiction.

People learn through their entire lives. They constantly improve their knowledge and develop. I think that a college or university education should be available to all students because every person has the right to choose the way to self-perfection. Bellow I will give some of my reasons to support my position.

First of all, every person should have the chance to get a higher degree, gain new knowledge and experience. However, some people believe that higher education should be available only to good students. I think it is silly. It is like to make unavailable traveling for one who does not have IQ high enough.
Second of all, some young people do not do well at school but they have great personality and ability to learn. They are self-confident, persistent and patient. With these qualities they can get higher grades then their classmates who are talented but lazy. Imagine for example situation when a teenager gets high grades because his or her parents constantly make him or her study and help to do most of the homework. In this case a child does very well at school but I think a college can show the opposite results.

Finally, it is a discrimination against students to make available higher education only for good ones. So, if a student does poor and gets low grades he/she should be sent down. But if a person was never given a chance to try himself/herself at college, what to do in this case?

To sum up, I think that all young people should have the chance to get a higher education. To take or not this chance must be up to them.

In some countries young people are encouraged to work or travel for a year between finishing high school and starting university studies. Discuss the advantages and disadvantages for young people who decide to do this.

It is quite common these days for young people in many countries to have a break from studying after graduating from high school. This trend is not restricted to rich students who have the money to travel, but is also evident among poorer students who choose to work and become economically independent for a period of time.

The reasons for this trend may involve the recognition that a young adult who passes directly from school to university is rather restricted in terms of general knowledge and experience of the world. By contrast, those who have spent some time earning a living or traveling to other places have a broader view of life and better personal resources to draw on. They tend to be more independent, which is a very important factor in academic study and research, as well as giving them an advantage in terms of coping with the challenges of student life.

However, there are certainly dangers in taking time off at that important age. Young adults may end up never returning to their studies or finding it difficult to readapt to an academic environment. They may think that it is better to continue in a particular job, or to do something completely different from a university course. But overall, I think this is less likely today, when academic qualifications are essential for getting a reasonable career.

My view is that young people should be encouraged to broaden their horizons. That is the best way for them to get a clear perspective of what they are hoping to do with their lives and why. Students with such a perspective are usually the most effective and motivated ones and taking a year off may be the best way to gain this.
